Can you Change Terms? A contract of employment is a legally binding agreement. Once it is made, both parties are bound by the terms and neither party can alter those terms or implied terms without the agreement of the other.  Where a practice e.g. homeworking has become custom and practice it could be argued that it has become an implied term and therefore a contractual entitlement. As such this advice would apply to implied terms that are not written as well. However, during the course of employment, terms of employment may need to change. This may be due to changes in working methods, a change in the structure of the business or the job roles.
