4. Consultation
In order for a redundancy to be fair, as well as it meeting the definition of redundancy and using a fair Selection Criteria, the employee must be consulted with regarding the redundancy: This includes:
Informing the employee that they are at risk of redundancy (this may mean informing everyone in the pool that they are at risk and then doing the scoring and selection). Those who score lowest will remain 'at risk'.
Entering into a formal ‘consultation period'. There is no 'legally defined' period for consultation where there are less than 20 redundancies. However, a minimum of two weeks would be suggested as there must be enough time for meaningful consultation.
